TERMS AND CONDITIONS FOR ADVERTISERS

DEFINITIONS:

“Buyer” – The person or business named on the listings form
“Company” – Showdigs.co.uk
“Website” – www.showdigs.co.uk
“Listing” – The advert sold to the buyer, to be displayed on the website.
“Listings form” – The form completed by the buyer, which specifies that these conditions apply to it.
“The Contract” – The arrangement between buyer and seller, comprising the listings form, receipt of payment and these
conditions


1. SERVICE:
1.1 The company will provide the buyer with a listing on the website (designed to a showdigs template), the purpose of which is to advertise the buyer’s accommodation to people within the entertainment industry.
1.2 The listing will be produced from the information provided on the completed listings form. Any details to be added to the listing should be requested in writing to the company.
1.3 Contact details will be omitted from the basic listing, to be viewed only by members of the website who have logged-in.

2. GUARANTEE:
2.1 The company guarantees to include the listing on the appropriate web page within 7 working days of receipt of payment, unless otherwise arranged with the buyer. If this guarantee is broken a full refund will be provided whether the buyer decides to continue with their listing or not.

3. PRICE:
3.1 The prices will be as follows:
£32.00 per year
3.2 Additional listing options may become available (ie featured digs) which may be offered to the buyer at an additional cost.
3.3 These prices are subject to change. In this case the buyer will be advised of the new prices before contracts are made/renewed.

4. PAYMENT:
4.1 Payment will be required by cheque or via an internet “Nochex” account. The listing will be created on receipt of the payment and will be displayed on the website within 7 working days thereafter (see 2.1).

5. CONSEQUENTIAL LOSS:
5.1 The company is not liable for any consequential loss of earnings or otherwise through advertising on the website (see 6.2)

6. BUYERS’ RIGHTS:
6.1 The buyer is allowed 7 working days from the time the listing is displayed on the website to request an alteration or termination of a new listing (“cooling off” period). If the listing is removed from the website as a consequence a full refund will be issued.
6.2 If the buyer expresses dissatisfaction with the listing after the 7 day “cooling off” period the company will endeavour to alter the listing to the buyer’s requirements. Where this is not possible the listing will be removed from the website and a refund will be issued. If the listing has been displayed on the website for more than 7 working days the refund will be reduced accordingly (See 8.6)
6.3 No addition to or variation of these conditions will bind the company, unless it is specifically agreed in writing and signed by a director of the company. No agent or person employed by or under contract with the company has the authority to alter or vary these conditions in any way.

7. DATA PROTECTION ACT:
7.1 The company adheres to and is bound by the data protection act. The company is registered with the Information Commissioner’s public register of data controllers.
7.2 Information received from the buyer is used only in conjunction with the website and is not given to any third parties for mailing lists or otherwise.
7.3 The company reserves the right to save and print copies of listings to sell to members of the website who are unable to reach the Internet whilst on tour.


8. DURATION AND TERMINATION:
8.1 The buyer may request to change or terminate their listing at any time. (see 7.2)
8.2 The contract begins on the date the listing is displayed on the website. This date will be stated at the bottom if the listing and notified to the buyer on the receipt of payment.
8.3 The contract will last for a duration agreed by the buyer and the company at the initial point of contact. This will be clarified on the buyer’s receipt of payment.
8.4 The buyer will be contacted by the company 3 weeks prior to the contract expiring and will be offered the opportunity to renew the contract. If this has not been agreed before the final date of the contract the listing will be removed from the website and the contract terminated.
8.5 Any changes to the listing or early termination of the contract requires seven working days notice, in writing from the buyer.
8.6 Early termination will result in a reduced refund depending on the remaining length of the contract. The full listing price paid (as stated on the receipt) will be divided into the number of months of the agreement period. The refund will amount to the cost of the number of whole calendar months the contract was due to last after the notice of termination.
8.7 No refund will be given for a contract terminated with less than one month left of the contract.
